The Rainbow Clause:
Giving us the right to choose who; where; when; why; and how.
The Gay Rights Movement Today
Today the gay rights movement is louder than
it has ever been before. Never before has the gay community made presidential
candidates squirm under their scrutiny, and made them tiptoe over delicate
issues in the fear of alienating voters. Sure, we still have a long way to
go, but we've come a long way. And the recent victories on all fronts prove
that equality is not far off.
Granted, it is easy to get discouraged especially
in light of all of the Defense of Marriage Acts and State Constitutional
Amendments barring gay marriage. But if you look at it a different way, you
can't help but get excited. Think about it this way: Why are people so scared?
Why are they spending so much energy and time trying to prevent us from getting
married and enjoying equal rights and benefits if they weren't scared stiff
with the fact that we were on the verge of doing so? It's like I tell my
girlfriend... We will be married within the next 10 years and that marriage
will be recognized from coast to coast. The signs are obvious.
Today we have more gay rights organizations
than there ever were before and those organizations have more clout than
politicians like to give them credit for. They include the Human Rights Campaign;
National Gay and Lesbian Task Force; Parents and Friends of Lesbians and
Gays (PFLAG); and the Gay and Lesbian Alliance Against Defamation. Even
conservatives and Republicans are in on the movement with their own pro-rights
groups such as the Log Cabin Republicans, and the Independent Gay Forum.
Perhaps the most exciting development that occurred
recently was the June 2003 ruling in Lawrence vs. Texas. That ruling overturned
the sodomy laws still on the Texan law books and invalidated all of the other
existing sodomy laws in the United States by deeming them unconstitutional.
And Massachusetts became the first state to
legalize same-sex marriage. Never mind that dozens of states passed measures
to protect them from the scourge of gay marriage. We have Massachusetts,
and where we have one, more will follow. In fact, many states - in an effort
to be fair and equal - have started to provide civil unions as an alternative
to marriage. These legal unions provide some of the protections that marriage
does, but still do not quite take the cake.
Still more exciting is the fact that just a
few months ago a West Virginia family court awarded custody of a child to
the non-biological parent of a same-sex relationship. This ruling opens up
the way for all courts to recognize the parental rights of a non-biological
parent.
What's next? Only time will tell. But the truth
is that we are on the verge of the most exciting time in the gay and lesbian
rights movement history. So, the next time you see an over pompous, hypocritical
preacher casting all of gays and lesbians into a fiery hell, remember that
those are words of a drowning man. He will be silenced, and he can go home
and live his "morally upright" life complete with his wife, kids, and mistress
and allow you to live yours. The time is
coming.
